Statutes controlling public funds investment and depositories in Texas are found in the Government Code and
Local Government Code. Copies of the primary Acts, as amended, are provided below along with a link to the
Texas Legislative website. In addition, links to other states investment laws for public entities are
included below.
TEXAS INVESTMENT LAW
Texas Public Funds Investment Act 2011This Act applies to all governmental entities in Texas. Created in 1987, it has been amended in every
legislative session since. The Act is not cumulative so certain specialized areas (such as water districts)
may have statutes in conflict with the Act.
Texas Public Funds Collateral Act 2013
This Act controls all aspects of collateral pledged to governmental entities in Texas for time and
demand deposits. Created in 1989, it is cumulative legislation which supercedes all other collateral
conditions.
Municipal Fund Depositories These statutes apply to the funds of any school district, municipality or any department or agency of
the municipality. It covers choosing and establishing a depository. This allows for multiple
depositories.
